1. Who provides Ask Austin

Ask Austin is an iPhone app through which Austin Gauthier personally provides baseball education and feedback. Austin writes every written answer, records every video answer, and takes every call himself. Answers are not written by an AI.

Ask Austin is provided by Austin James Gauthier, an individual (the seller shown on the App Store). In these terms, "we", "us" and "our" mean Austin James Gauthier, and "you" means the person who holds the Ask Austin account. Contact us through the support email below or from Help in the app.

2. Accounts and eligibility

You sign in with your email address and a one-time code. Keep access to that email account secure, because anyone who can read your sign-in codes can use your Ask Austin account.

Age. You must be 16 or older to create or hold an Ask Austin account. Children under 13 may never create an account or send us their information. A parent or legal guardian may buy services for a younger child in their care using the parent's or guardian's own account, and then remains responsible for that account, for what is submitted, and for supervising the child's training. Before you continue, the app asks you to confirm "I am 16 or older." Before your first purchase it asks you to confirm "I am 16 or older, or a parent or guardian buying for someone in my care." These confirmations are your own statements. The app does not ask for a birthdate or ID, does not verify your age, and these confirmations are not parental consent under any law.

3. The services

Prices are shown in the app before you pay. Each purchase covers one service for one account.

Service What you get Follow-up Timing
Message (App Store purchase) You send one written question. Austin writes a personal answer. One follow-up question, which you can send during the 7 days after Austin's first answer. Austin answers it once more. Austin has 24 hours after your payment is verified to answer, and 24 hours after your follow-up to answer it. The clock is elapsed hours, not calendar or business days.
Video (App Store purchase) You send one question and may add one video clip. Austin records a personal video answer. No follow-up. Another question needs a new purchase. Austin has 24 hours after your payment is verified to answer.
Call (card payment through Stripe) A live one-on-one call with Austin for 15 minutes at the open time you pick. A join link appears in the chat when Austin adds it. No written follow-up. The call happens at the booked time. The 24-hour answer deadline does not apply to calls.

The current answer window (24 hours), follow-up window (7 days) and call cancellation cutoff (24 hours) are settings that may change for future purchases. The values shown in the app when you buy are saved with your order and apply to that purchase.

Availability. Austin limits how many messages and videos he accepts each day, and he may pause new purchases at any time. When sales are paused or the daily limit is reached, you cannot buy. Call times are limited to the open times shown.

Declining a request. Austin may decline a question he cannot answer appropriately (for example, a question that needs a medical professional or that breaks Section 9). If he declines a paid request, a refund starts under the Service, Cancellation and Refund Policy.

Your information. Advice is based only on the information, descriptions and video you provide. Austin cannot see what you leave out, and feedback may be incomplete or wrong if the information is incomplete or inaccurate.

4. Baseball education only: not medical or other professional advice

Ask Austin provides baseball education and coaching feedback. It is not:

Feedback through the app cannot replace an in-person assessment by a qualified coach, athletic trainer, physician or other professional who can examine the athlete.

Stop and get care. Stop any activity that causes pain, numbness, dizziness, or an injury, and get appropriate qualified care before continuing. Do not use Ask Austin to decide whether an injury needs treatment.

Not an emergency service. Ask Austin is not monitored for emergencies and answers can take up to 24 hours. In an emergency, call 911 or your local emergency number.

5. Training risks

Baseball and physical training involve risks, including injury. Examples include overuse injuries to the arm, shoulder and elbow, muscle strains, sprains, and impact injuries from balls, bats and falls. The risk depends on the athlete's age, health, conditioning, workload, equipment, supervision and environment, which Austin cannot observe or control through the app.

You (or, for a child, the parent or guardian) decide whether and how to apply any feedback, and are responsible for appropriate supervision, warm-up, workload, rest, equipment and a safe place to train. Children should apply training feedback only under adult supervision.

6. No guaranteed results

Austin's feedback is his opinion based on the information you provide. We do not promise or guarantee any result, including improved performance or statistics, injury prevention, making a team or roster, playing time, college recruitment or scholarships, being drafted, or any professional opportunity.

8. Content you submit

Your permission to upload. Only submit questions, videos and other material that you created or have permission to share. If a video shows other people, you must have their permission (for anyone under 18, their parent's or guardian's permission) to share it with Austin for feedback.

What you allow us to do. You keep ownership of your content. You give us permission to store, process, view and copy your content only as needed to provide the service you bought, keep records described in the Privacy Policy, handle support, refunds and disputes, prevent abuse, and meet legal obligations.

What these terms do NOT allow. These terms do not give us permission to:

Any of those uses would need your separate, specific, optional permission, which you could refuse without losing access to the service.

Austin's answers. Austin's written and video answers are provided for your personal, non-commercial use. Please do not republish them publicly or sell them.

9. Conduct and prohibited content

Do not use Ask Austin to:

Reporting. Report a problem, abusive content or a safety concern by emailing support (Section 1) with your account email and the chat involved. Content involving the exploitation of a child will be reported to the appropriate authorities.

How we handle violations. Depending on severity, we may decline the request (with a refund under the refund policy), remove content, or block the account. A blocked account cannot make new purchases. We may preserve information and report to authorities when the law requires it or when someone's safety is at risk.

10. Account deletion

You can delete your account in the app at any time: Account, Delete account, then type DELETE. The Privacy Policy explains what is removed and the minimal records we keep. Deleting your account does not by itself refund a purchase; App Store refunds are handled by Apple.

11. Changes to the service and these terms

We may update these terms. If a change is material, the app will ask you to review and accept the new terms before you start a new purchase, question, upload or call booking. Changes do not apply retroactively to purchases you made before you accepted them: each purchase keeps the terms, deadlines and remedies that were shown when you bought it. You can always read the legal documents, contact support, delete your account, and use services you already paid for without accepting new terms.

Except as stated in these terms and to the extent permitted by law, the app and the services are provided "as is" and "as available". We do not promise that the app will always be available or error-free. Nothing in this section limits any promise we make in these terms, including the delivery deadlines and refund remedies in the Service, Cancellation and Refund Policy, or any warranty or right that cannot legally be excluded.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, which may include liability for gross negligence, willful misconduct, fraud, death or personal injury caused by negligence, or rights you have under consumer-protection laws. Saying that you use the app "at your own risk" would not remove our responsibility for our own conduct, and these terms do not claim that it does.

16. Apple

If you got the app from the Apple App Store: these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
